Terms & Conditions

Apply to all website development / design services provided by Aniz Studio to the Client :

terms and condition icoBy placing an order with ANIZ STUDIO, you confirm that you are in agreement with and bound by the terms and conditions below:

  1. This contract is between ANIZ WEB SOLUTIONS (ANIZ STUDIO) and you (the client).
     
  2. ANIZ STUDIO will carry out work only where an agreement is provided by email or letter. An 'order' is deemed to be a written contract between ANIZ STUDIO and the client. All invoices are based on quotations that have been provided in writing (an email or a letter), in advance by ANIZ STUDIO.
     
  3. Payment terms are strictly 50% of the design fee before work commences, then the reminder upon completion prior to the site going live on your domain. Different payment terms may apply to special offers. All payments are non-refundable.
     
  4. If the website design is cancelled by the client before completion then the deposit together with any other payment are forfeited and any balance due must be paid immediately.
     
  5. Invoices are due for payment within 14 days. ANIZ STUDIO retain the right to take down or suspend a website and cease email forwarding if payment is not made within these terms. The suspension or removal of a website does not in any way restrict ANIZ STUDIO from any further actions to recover outstanding payments.
     
  6. All websites will show the text "Web designed by ANIZ STUDIO" (or something similar) at the base of each web page. This text can be omitted at a cost of RM5,000 per site. We reserve the right to reinstate this and remove your administrative rights, should this be removed without our permission. No other marketing company or consultant is allowed to have any attribution to the website design. We reserve the right to remove this and remove your administrative rights should this be added to the site.
     
  7. Once your site is live on your domain it is assumed that the project has been completed to your satisfaction. Any additional work is then charged at a rate of RM350 per update. Minor amendments such as change of address or telephone number will incur no charge.
     
  8. Should you choose the option of having administrative rights to your website you will be able to make changes to your own site and amend content. ANIZ STUDIO does not accept responsibility for any changes that you make to your site. Any advice on updating your site, or rectifying any changes you have made will be charged at the daily rate of RM150 per day.
     
  9. We require you to submit your own text and images for inclusion on your new website. All text should be divided into sections relevant to your page names and submitted by you in electronic format. All text and images submitted must be free of copyright and ANIZ STUDIO accepts no responsibility for any infringement of copyright law arising from any text or images used on your site. If you do not supply content before we create the initial draft we may use images from Google or any other search engine to "fill space" so that you can see what the site would look like complete. By keeping that content you accept responsibility for it. All spell checking is the responsibility of the client and any errors that need rectifying will be charged at RM150 per day. Any photos, logos or graphics you wish to include should be submitted by you in either Jpeg, png or gif format, either by post on a cd or by e-mail as an attachment.
     
  10. The client will promptly provide to ANIZ STUDIO any information that may be required to fulfil its obligations under the Agreement. Failure to do so within 3 months of a written request will result in the final balance being invoiced and payable by the client.
     
  11. All rights and copyrights for logos created will be transferred to the customer.
     
  12. We reserve the right to include a screenshot of, and link to your completed website on the portfolio page of our website and on any of our social media accounts.
     
  13. ANIZ STUDIO retains the rights to all code, design and functionality of websites that we create. We may reuse any code, design, or functionality from your site on another site.
     
  14. A website "page" is generally intended to mean a page of content no more than 2000 pixels deep which is approximately A4 in size. Individual pages with more than 2000 pixels will be charged as an additional page (per A4 sized page of content).
     
  15. ANIZ STUDIO will make every reasonable effort to ensure that your website is viewable on the major platforms. All sites can be viewed on Laptops, PC’s and Tablets running Internet Explorer, Mozilla Firefox and Google Chrome.
     
  16. If a domain name and web hosting needs to be purchased on your behalf this will be invoiced and paid for by the client at the outset together with the initial deposit. ANIZ STUDIO will register a domain name and web hosting on your behalf and we act as your agents with the registering authority. The client will retain full rights to the use of the name according to the relevant registering authority's terms once all payments due have been made. A RM150 transfer fee is applicable for the transfer of any domain away from the current host.
     
  17. The web hosting will be registered for 1 year. If the customer does not renew the services, the hosting will expire and your site will no longer be live. Once hosting has expired, it will be possible to reinstate your website for a period of 7 days by paying an admin fee of RM150. After 7 days your site will be permanently deleted. ANIZ STUDIO excludes liability for any loss of profit caused to the customer by the expiration of the hosting as a result of the customer's failure to renew the Services.
     
  18. All domain names will be registered in the clients name and as such the domain name belongs to the client, not to ANIZ STUDIO. The domain will be registered for 1 year. If the customer does not renew the services the domain will expire and will be available for general sale. No cash alternative is available for customers who purchase their own domain name.
     
  19. ANIZ STUDIO excludes liability for any loss of profit caused to the customer by the expiration of the domain name as a result of a technical fault or any other fault caused by any third party.
     
  20. ANIZ STUDIO excludes liability for any loss of profit caused to the Customer by the expiration of the domain name as a result of a technical fault of any other fault caused by the negligence of the site host.
     
  21. Website drafts will be created, based on the design brief and information provided by the Customer. If the brief changes after the first draft has been created which results in a complete redesign then a charge of RM150 per day will be applied. If feedback is not received within 30 days of supplying the initial draft we reserve the right to permanently delete the site from our hosted server and no refund will be payable. If we request more information and do not receive a reply for a period of 30 days we reserve the right to permanently delete the site from our hosted server and no refund will be payable.
     
  22. Should the final payment not be received within 30 days of the initial draft being produced ANIZ STUDIO reserve the right to charge for any services or extras that would otherwise be included free of charge. These include, but are not solely reserved to; domain name, hosting, extra pages and any extra work carried out, which will be charged at an hourly rate. Your website will only be made live once full payment has been received. Failure to make payment will result in account suspension.
     
  23. If the final payment has not been received within 1 months of the original order being placed ANIZ STUDIO reserve the right to cancel this agreement without notice. All design work carried out will be permanently deleted and no refund will be payable. Any domains or email accounts that may have been registered will also be cancelled and no refund will be payable. Failure to make payment will result in account suspension.
     
  24. Once a website has been designed and completed the final balance of payment is then due in accordance with ANIZ STUDIO payment terms. There are no exceptions to this. If a client decides they no longer want the site once they have commissioned the work, they are still obliged to pay for all work that has been done. Non payment will result in legal action being taken if necessary.
     
  25. ANIZ STUDIO will introduce your website to search engines but we cannot guarantee the ranking of your website on any search engine. Due to external factors we cannot offer any guarantees regarding the search engine position we will achieve for websites. We cannot accept liability for any change in rankings, or drop off in the position of your website due to changes in the algorithms of the search engines or the factors that they use to rank websites.
     
  26. Search Engine Optimization, SiteLock Security, Medium and Premium Website Maintenance services are annual (12 month) agreements. You will continue to be billed for the remainder of your contract, regardless of whether or not you use the service or have requested a cancellation.
     
  27. By entering into a contract with ANIZ STUDIO Search Engine Optimization (SEO) services , the client asserts that they have read and are aware of the following statement:
     
    1. SEO services by ANIZ STUDIO are annual (12 month) agreements. Monthly SEO fees may be paid with bank transfer, cheque or money order. SEO fees will be charged to the clients on the 1st or 15th day of every month. There are absolutely no refunds for any fees related to SEO services.
       
    2. Search Engines, particular Google have proprietary algorithms, techniques and software that affect how search results are ordered for a given search. These algorithms etc change periodically with a consequent change in ordering. ANIZ STUDIO tracks these changes in order to minimize down time when Your Site drops out of first page's results. It also means that while we may be able to guarantee that your site will eventually be located on first page, we cannot say exactly what ranking your site will have on first page or how much traffic this will bring.
       
    3. While a top ten ranking assignment means that the customer's page will be placed in the top ten in a search result, this can take up to 20 weeks to occur as we upload optimization to the customer's website. While Google results are often displayed on other search engine sites, ANIZ STUDIO is solely focused on producing optimised results for the Google search engine only. It is our primary goal to increase visibility and to gain a higher search engine rank for our clients. This again, applies only to Google.
       
    4. ANIZ STUDIO must thoroughly stress that there is no guarantee to our SEO services. We do not have the ability to offer an ironclad guarantee on the rank that our customers will receive. We also cannot calculate or even estimate the amount of increased traffic that will occur as a result of our optimisation services. Marketing online is unpredictable and ANIZ STUDIO cannot in any way guarantee the position that a site will earn except that it will be on the first page.
       
    5. Our customers must supply ANIZ STUDIO with their logins and passwords for FTP purposes to allow us full access to the website. ANIZ STUDIO will fully protect all login and password information, keeping it under the tightest security. It is vital that customers inform their webmaster and any other individuals that work with their website that ANIZ STUDIO is optimising the website.
       
    6. ANIZ STUDIO will make the final and complete decision on which search engines they deem most important to work with, however it's almost always going to be Google.com, .com.my or some other local variant. We will base our decision solely on these factors: content, location, language, popularity or any other attribute that we feel is important to consider.
       
    7. ANIZ STUDIO will suggest phrases that search engine users will search for at their discretion. The positioning of these words will be used in the optimisation process. A listing is the search result page of a word or phrase that ANIZ STUDIO has typed into a search engine. This will provide the positioning of the customer's website in the search engine listing. The customer's website name and possibly links to the customer's website will be included in the listing. The words that ANIZ STUDIO chooses will be for test purposes and will be considered a test phrase. Although these websites and links will be listed with other testing phrases, there will be only one single test phrase in the report that we prepare.
       
    8. In case of any invalidity or un-enforceability of any portion of this agreement shall in no way affect, impair, or nullify any other portion of this provision. No waiver of the due rights that ANIZ STUDIO has under the protection of this agreement shall occur due to any failure of ANIZ STUDIO to successfully enforce any portion of this agreement.
       
  28. By entering into a contract with ANIZ STUDIO Medium or Premium Website Maintenance services , the client asserts that they have read and are aware of the following statement:
     
    1. Medium and Premium Website Maintenance services by ANIZ STUDIO are annual (12 month) agreements.
    2. Monthly Website Maintenance fees may be paid with bank transfer, cheque or money order.
    3. Website maintenance fees will be charged to the clients on the 1st or 15th day of every month.
    4. Website maintenance Fees will be prorated for new clients that sign up in the middle of a given month.
    5. After the initial 12 months, the client may terminate this agreement without paying any additional fees with 30 days written notice.
    6. ANIZ STUDIO may terminate this agreement at anytime with written notice to the client.
    7. There are absolutely no refunds for any fees related to website maintenance services.
    8. When adding new text and/or content to a page the client is responsible for providing all text (in digital format) and images/photos.
    9. There is no roll-over for any website maintenance plan services.
    10. “Update turnaround time” is based on item updates. Advanced programming may result in longer turnaround times.
       
  29. ANIZ STUDIO reserve the right to refuse to handle in any way, material which may be deemed offensive, illegal or controversial. We also reserve the right to refuse to handle any site found to be involved in any black hat or “spammy” search engine optimisation techniques. Should any of these situations arise we reserve the right to terminate your web hosting service without notice and you would not be due a refund.
     
  30. ANIZ STUDIO shall not be directly or indirectly liable for any damages suffered by the client; for any losses incurred due to malfunction of the website or any part of it.
     
  31. Should the client decide to transfer their website from our servers, provided all outstanding invoices are settled we will co-operate professionally and in a timely manner with your new supplier. An administrative charge of RM150 will be levied.
     
  32. Our services are not available for resale. By placing the order you confirm you are the end recipient of the website. If we establish you have ordered a website on behalf of somebody else the website in question will be deleted from our hosted server immediately and no refund will be paid.
     
  33. We reserve the right to amend the Terms and Conditions at any time.

HOW WE WORK

INITIAL DISCUSSION

This initial discussion is a chance for us to get to know each other a little, for you to ask any questions you may have and to tell us about the type of website you require.

50% DEPOSIT

Payment terms are strictly 50% of the design fee before work commences, then the reminder upon completion prior to the site going live on your domain.

DOMAIN NAME & HOSTING

Once we have received the 50% deposit on confirmation to commence work, we will proceed to register any domain names and setup of a web hosting account if required.

WEBSITE CONTENT

Client have to provide us with all the data needed to complete web site, including text in Microsoft Word, company logo, and photos in JPEG/PNG format.

DESIGN & DEVELOPMENT

Production of initial design and layout concept of your website. Completion of job is within 4 to 6 weeks (Depends on content and complexity of design).

BALANCE PAYMENT

Once the look and feel of the website has been agreed, balance 50% and any additional costs incurred during development will be invoiced to you.

LAUNCH OF WEBSITE

Launch of website - Once we have received the final payment, we will activate your web site and submit it to the search engine and directory so your site gets seen.

ONGOING SUPPORT

Website ongoing support - Our website maintenance plan takes the time and hassle out of managing your own website and keeps it performing at its very best.
